CONSTRUCTION ACCIDENT

Facts:

A Honduran male fell approximately 50 feet from a roof onto a sidewalk bridge. As a result of this accident, the plaintiff sustained catastrophic and totally disabling personal injuries, is a wheelchair bound cripple and has a permanent and total loss of use of his lower extremities. He has had multiple surgical procedures including abdominal surgery, spinal surgery, and surgery to the left humerus. The plaintiff was rendered a paraplegic. His pain is permanent and so agonizing that he must take methadone each day and will have to take methadone everyday for the rest of his life.

Settlement:

The case was settled for $12,800,00.00 after jury verdict.

CONSTRUCTION ACCIDENT

Facts:

A black male, while employed as a journeyman sheet metal worker attempted to push a manual Genie Lift up a ramp and was caused to fall due to the defective nature of the ramp. He sustained a severe injury to his right thumb metacarpal joint requiring insertion of external and internal fixation of the right thumb.

Settlement:

The case was settled for $1,800,000.

CONSTRUCTION ACCIDENT

Facts:

A Puerto Rican male was caused to fall from a ladder while performing construction related work. The plaintiff was standing on a ladder installing ceiling fans when the ladder tipped over, propelling him to the ground. At the time of the accident, no one was holding the ladder to secure it to prevent it from tipping, slipping or falling, nor was the plaintiff provided with safety devices to prevent him from falling. As a result of this accident, the plaintiff sustained severe fractures to both wrists and arms. These injuries required multiple hospitalizations and multiple surgeries on each arm.

Settlement:

A Bronx County jury awarded the plaintiff $10,000,000 in damages. The case was settled for $5,750,000.

CONSTRUCTION ACCIDENT

Facts:

A Honduran male, while engaged in carpentry work, fell approximately 30 feet when the scaffold on which he was standing collapsed beneath him. Simultaneously, parts of the scaffold continued to fall on top of him as he fell to the ground. This accident occurred due to defendants' failure to provide plaintiff with a properly constructed and safe scaffold. Defendants also failed to provide plaintiff with safety devices that would have prevented the fall. Due to this accident, plaintiff sustained posterior cervical disc herniations at C5-6 and C6-7, thoracic disc herniations and collapse at T10-11 and T12-L1; and lumbar disc herniations at L2-3 and L5-S1.

Jury Award:

The case was settled for $3,000,000.00.

NEGLIGENCE

Facts:

An Ecuadorian male sustained serious and egregious life threatening and life altering injuries when a pallet of hardwood flooring toppled from a flatbed truck and fell on him while he was standing on the sidewalk below. The plaintiff sustained fractures to the right tibia and right fibula, requiring closed reduction of both fractures, a fracture of the pelvis, fracture of the sacrum, fracture of the left 11th rib and a tear in the right shoulder.

Jury Award:

A Bronx County jury awarded the plaintiff and his wife $8,741,200.00 in damages. The case was then settled in the amount of $4,000,000.00 (the limit of insurance).

SLIP AND FALL ACCIDENT

Facts:

A Dominican female was caused to slip and fall on a wet step of a metal staircase while descending the stairs to the basement of the restaurant where she was employed. The staircase on which plaintiff's accident occurred was the only means of access from the floor above to the basement where she worked. The step was wet from a leak in the main sewer line that ran above the staircase and was a recurrent condition. Plaintiff sustained a comminuted, displaced intra-articular fracture of the left wrist that required the application of an external fixator.

Jury Award:

A New York County jury awarded plaintiff $773,900 in damages.

TRIP AND FALL ACCIDENT

Facts:

A Mexican female was caused to trip and fall due to a defect in front of a store entrance. She suffered injuries including a fractured skull.

Settlement:

The case was settled for $900,000.00.

TRIP AND FALL ACCIDENT

Facts:

A Honduran female, mother of four, was caused to sustain severe personal injuries as a result of a trip and fall accident due to a defective walkway within a building complex. Plaintiff sustained a fracture of the left elbow. She was compelled to undergo surgery, which included drilling holes and the use of multiple wires. Thereafter, the plaintiff was compelled to undergo a second surgery to remove the hardware from the left elbow.

Jury Award:

A Bronx County jury awarded the plaintiff $5,720,000 in damages.

AUTOMOBILE ACCIDENT

Facts:

A Haitian male driving an automobile was struck in the rear by another vehicle causing him to sustain a spinal injury.

Jury Award:

A Kings County jury Awarded the plaintiff and his wife $11,780,000.

LEAD

Facts:

At the age of three, infant plaintiff was found to suffer from lead poisoning with a blood level of 42. The child suffers from lead toxicity syndrome, plumbism, lead storage in bones and soft tissue, lead intoxication, vomiting, nausea, diarrhea, anemia, abdominal pain, headaches, severe loss of appetite/loss of weight, hyperactivity, attention deficits, learning disabilities, loss of developmental potential, neurological deficits, poor fund of knowledge, speech problems, loss of intelligence, adjustment disorder with depressed mood, perceptual-processing disability, emotional upset and distress, probable organic brain damage, and loss of enjoyment of life.

Settlement:

The case was settled for a structured settlement valued at $3,000,000.
